This story is coming more into focus as the afternoon wears on. Initially, it was widely reported there was a subpoena issued to Fulmer at Media Days. Shortly thereafter, Fulmer issued a denial, saying he’d seen no subpoena.

Memphis Tider clarifies the reason for that situation for us this afternoon:

Apparently, Fulmer has not even looked at the document, and didn’t know what it was for. It was given to him as his car pulled into the parking lot at the Wynfrey Hotel this morning and he just threw it in the car.

It’s been noted that the date of the subpoena is September 25 - the Thursday before Tennessee is scheduled to play at Auburn. I suppose that’s a good thing for Auburn fans, but I wouldn’t be shocked if the judge in the case allows Mr. Fulmer to handle this matter at a more convenient time. Only time will tell.

There’s lots of noise among the Tennessee faithful that this is just one more case of the “Bama Nation” (and allow a digression here, but that phrase grates on me huge) hanging on to old news. It’s not that the “Bama Nation” is hanging on to this bit of old news - it’s one man and a law firm. And, it’s a man who may or may not have been intentionally slandered by Phil Fulmer in attempt to get Alabama in NCAA jail.

If that’s the case, then there’s no reason that these attorneys shouldn’t be able to depose Fulmer. If the suit were frivilous or had no merit, it would have been dismissed. If Fulmer had nothing to contribute to the proceedings, then he wouldn’t have been issued a subpoena.

It’s a legal process and it’s one the NCAA may ultimately prevail in. But it’s not some “Bammer” chasing an old issue. It’s a man trying to clear his name.
